In these Terms and Conditions “Company” means Safety Aware Limited, Company No 4355281
Registered address 3-4 Bower Terrace, Tonbridge Road, Maidstone, Kent.
The “Customer” means the person or persons and/or Companies that order the goods or services. The “Goods or Service” means the goods, products or service offered by the Company and more particularly specified in the order form and Company invoice.
These Terms and Conditions apply to all contracts for Services between the Customer and the Company, to the exclusion of any terms and conditions specified by the Customer.
Copyright Handout and Presentation Material
All handout and presentation material packs developed by or on behalf of the Company remain the intellectual property of the Company except where otherwise specified. It is agreed however, that the Customer may use the Company’s handouts and presentation material/packs for strictly the training of the Customers’ employees at the Customers’ premises provided that if the Customer has more than one set of premises it shall be those premises specified on the order form and invoice.
Fees
All prices quoted are subject to confirmation at time of order and are exclusive of expenses and VAT, which will be chargeable in accordance with legislation at the date of supply. Where applicable, the Company accepts no responsibility for fees set by external organisations, their fees may alter without prior knowledge and will be invoiced accordingly. External Organisations are defined as organisations or companies, which are outside of our control, such as NEBOSH or IOSH.
Payment for Services
Payment should accompany the completed booking form whereby a VAT invoice will be issued. Payment should be received no later than 7 days prior to commencement of the course to secure a place, failure to pay by the deadline may result in refusal of entry to the training course in question.
Variable costs, which may not be established until completion of the service, (i.e. example, expenses; charge for additional handout materials; etc) are to be paid within 7 days of the additional invoice date.
Where residential accommodation is provided as part of the service, it will be necessary to pass to the Customer any cancellation charges relating to this. Failures to effect payment when due may result in interest charges of 8% on amounts outstanding.
Cancellation Arrangements
The Company reserves the right to cancel or alter the dates of provision of service and the individual providing the service. The Company shall not be responsible for any failure to perform its obligations hereunder due to circumstances beyond its control.
